Supreme Court hearing today

New Delhi: The Supreme Court on Tuesday will take up for preliminary
hearing, a batch of petitions filed by self-financing engineering
colleges in Tamil Nadu opposing the provision related to surrender
of 65 per cent of the seats to the Government.
The High Court, in its common judgment on July 12, had struck
down the provision for surrender of 65 per cent seats to the
Government by private colleges with only 35 per cent seats for
the management. However, it held that the ruling would be effective
only from next year.
SLPs filed
Assailing the High Court judgment, St. Joseph’s College
of Engineering, Sri Venkateswara College of Engineering and
six others have filed special leave petitions seeking quashing
of the judgment and interim stay on its operation.
On a mention made by counsel Mariarputham on Monday, a Bench
headed by Chief Justice K.G. Balakrishnan directed that the
matter be included for hearing in Tuesday’s ‘mention
list.’
The petitioners contended that after striking down the legislation,
the High Court could not direct them to surrender the seats
on the same proportion as stipulated in the Act. Issuance of
such directions would amount to exercise of the powers vested
in the Supreme Court, which were not available to the High Court.
“Factually incorrect”
They said that the submissions made by the State Advocate-General
in the High Court that 160 engineering colleges had given their
consent for surrender of seats was factually incorrect.
It appeared that only 64 colleges had given such consent.
Pointing out that the apex court had already stayed the High
Court order in so far as Chettinad Medical college was concerned,
they said the interim stay should be granted to them too.
