Court ruling on teacher training institutes
CHENNAI: Teacher training institutes which are given recognition
by the National Council for Teacher Education till April of
a particular year alone will be entitled to be considered by
the State Government for approval of teachers, admission of
students and commence classes for that academic year, the Madras
High Court has ruled.
Passing orders on a batch of writ petitions filed by the private
self-financing teacher training institutes on Friday, Justice
P. Jyothimani said though the NCTE could grant recognition throughout
the year, the Director of Teacher Education, Research and Training,
shall consider only April as cut off period for granting approval.
“In cases where the NCTE has granted recognition of institutes
beyond April, the State authorities being the examining body
are entitled to consider the approval of teachers, etc., for
the next academic year only. It shall be intimated to the institute
concerned, making it clear that no student shall be admitted
before granting such approval by the Director,” the Judge
said.
He further said: “[it is] needless to reiterate that from
the academic year 2008-09, unless the Director grants approval
within the time specified, no institute shall admit students
and those who are admitted without the approval are not entitled
to take part in the examination .”
Mr. Justice Jyothimani rejected the argument by the institutes
that they be permitted to admit students from the date when
the application for recognition was made to the NCTE. “I
am afraid that this condition will create complications in the
academic stream and also it is against the well considered principle
that no student can be admitted before recognition or affiliation
by the competent authorities and the university concerned. The
law is very clear that such sympathy, if shown to students,
would be a misplaced sympathy…Simply because the application
was made for the purpose of recognition there can be no presumption
that the recognition is from the date of application, ignoring
the time taken by the authorities for consideration.”
However, noting that unguided powers could be misused by authorities,
he asked the Directorate to clear all pending applications,
submitted by the institutes in 2006-07, within 10 days. The
admission process, including the management quota for 2007-08,
too, shall be completed within 10 days to complete the required
number of working days by July or August 2008.
As for the calendar of academic activities, he said: “The
State Government is empowered to approve the list of teachers
and being the examining body, it is entitled to prescribe the
calendar for every academic year in respect of the number of
term days of students and conducting examinations. Such activities
are only regulatory in nature, in fact, for better administration
of the basic policy enunciated by the National Council for Teacher
Education.”
